1. Acceptance of Terms

By accessing or using the OutreachPilot platform ("Service"), operated by OutreachPilot ("we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms apply to all users of the platform, including visitors, registered users, and anyone who accesses the Service.

2. Description of Service

OutreachPilot is an AI-powered outreach and sales automation platform that provides:

  • Multi-channel outreach campaigns (email, LinkedIn, SMS, and phone)
  • AI-driven lead research, scoring, and personalization
  • Power dialer with concurrent calling capabilities
  • AI Pilot auto-responder for managing replies
  • Contact management and CRM features
  • Research Suite for competitive analysis and market intelligence
  • Knowledge base upload for AI-powered personalization
  • Campaign analytics and performance tracking

3. Account Registration

To use OutreachPilot, you must sign in using Google OAuth. You are responsible for maintaining the security of your Google account and for all activity that occurs through your OutreachPilot account. You must provide accurate information and promptly update any changes. You agree to notify us immediately of any unauthorized access or use of your account.

4. Credit System & Billing

OutreachPilot operates on a credit-based system. Credits are consumed when you use platform features such as sending emails, making calls, running AI research, finding leads, and other actions. Specific credit costs for each action are displayed in the platform dashboard.

  • Credits are non-refundable once consumed
  • Unused credits may expire as outlined in your plan terms
  • We reserve the right to adjust credit pricing with reasonable notice
  • Payment processing is handled securely through Stripe
  • You are responsible for all applicable taxes associated with your use of the Service

5. Acceptable Use

You agree to use OutreachPilot in compliance with all applicable laws and regulations. When using our platform, you must:

  • Comply with all applicable anti-spam laws, including CAN-SPAM, GDPR, CASL, and other relevant regulations
  • Only contact individuals and businesses through lawful means
  • Maintain accurate and up-to-date contact lists
  • Honor opt-out and unsubscribe requests promptly
  • Use AI-generated content responsibly and review it before sending
  • Respect LinkedIn's terms of service when using LinkedIn automation features
  • Not misrepresent your identity or affiliation in outreach communications

6. Prohibited Uses

You may not use the Service to:

  • Send unsolicited bulk messages (spam) in violation of applicable laws
  • Harass, threaten, or intimidate any individual or organization
  • Distribute malware, phishing attempts, or other malicious content
  • Violate any applicable local, state, national, or international law or regulation
  • Infringe upon the intellectual property rights of others
  • Attempt to gain unauthorized access to the Service, other accounts, or connected systems
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Resell, sublicense, or redistribute access to the Service without our written consent
  • Use the platform for any illegal, fraudulent, or deceptive purpose
  • Circumvent platform rate limits, credit systems, or security measures

7. Intellectual Property

The OutreachPilot platform, including its software, design, logos, features, and documentation, is owned by OutreachPilot and protected by intellectual property laws. You retain ownership of the content you upload (contact lists, templates, knowledge base documents). By uploading content, you grant us a limited license to process it as necessary to provide the Service.

8. AI-Generated Content

OutreachPilot uses artificial intelligence to generate email content, research reports, lead summaries, and other materials. While we strive for accuracy, AI-generated content may contain errors or inaccuracies. You are solely responsible for reviewing, editing, and approving all AI-generated content before it is sent or used. We disclaim liability for any consequences arising from the use of AI-generated content.

9. Third-Party Integrations

The Service integrates with third-party platforms including Google, LinkedIn, email providers, telephony services, Slack, and Stripe. Your use of these integrations is subject to the respective terms of each third-party service. We are not responsible for the availability, accuracy, or policies of third-party services.

10. Data & Privacy

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to our data practices as described in the Privacy Policy.

11. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may temporarily suspend access for maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to notify users of planned downtime in advance.

12. Limitation of Liability

To the maximum extent permitted by law, OutreachPilot and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of revenue, profits, data, or business opportunities, arising from your use of the Service.

Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

13. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will meet your specific requirements, achieve particular outreach results, or operate without errors.

14. Indemnification

You agree to indemnify and hold harmless OutreachPilot and its affiliates from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

15. Termination

We may suspend or terminate your account at any time if you violate these Terms, engage in prohibited uses, or for any other reason at our sole discretion. Upon termination:

  • Your right to access the Service ceases immediately
  • Unused credits are forfeited and non-refundable
  • We may delete your data in accordance with our Privacy Policy
  • Sections that by their nature should survive termination (including liability, indemnification, and dispute resolution) will remain in effect

16. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by updating the "Last updated" date and, where appropriate, providing notice through the platform. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

17. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration or in the courts of competent jurisdiction.
